When should you contact us?
If your business is losing liquidity, overdue debts are growing or current liabilities are becoming difficult to meet, it is worth understanding the available options and their consequences. We assist both at the first signs of financial distress and when an application or support in ongoing proceedings is needed.
We assess the company’s position, debt structure and prospects for continuing operations. This helps us identify an appropriate course: negotiations with creditors, restructuring or preparation for bankruptcy proceedings.
How we can help
- Assessment of your situation. We explain how possible solutions may affect business assets, contracts, enforcement proceedings, relations with creditors, owners and management board members. We identify risks, obligations and next steps.
- Bankruptcy petitions. We prepare petitions for businesses and individuals, including consumer bankruptcy, and help gather the required documents and information.
- Restructuring procedures. We prepare applications and documentation for arrangement approval proceedings, accelerated arrangement proceedings, arrangement proceedings and rehabilitation proceedings (sanacja). We help select the procedure appropriate to the business.
- Restructuring plans and arrangement proposals. We prepare recovery measures, debt repayment proposals and documents needed for creditor discussions and proceedings.
- Negotiation and representation. We support discussions with creditors, represent clients in bankruptcy and restructuring proceedings, prepare submissions and assist with the Polish National Register of Debtors (KRZ).
Acting as a supervisor
Our restructuring advisers can act as arrangement supervisors in arrangement approval proceedings. They assist with documentation, creditor communications, collecting votes and the arrangement approval process. They may also act as court supervisors or administrators following a court appointment.
We also undertake supervisory and administrator roles through our affiliated company BM Restrukturyzacje. The scope of cooperation reflects the separate roles of the participants in the proceedings.
Your first consultation
We discuss your situation, the available options and the support you need. Please prepare information on debts, assets, key contracts and enforcement proceedings. Consultations are available online or at our offices.
